Ban on Residential Burning of Limbs and Leaves in Unincorporated Parts of Montgomery County has been Lifted

MONTGOMERY COUNTY, TX -- Recent rainfall has reduced our wildfire risk in Montgomery County, allowing for the lifting of the ban on residential burning of limbs and leaves, effective immediately.

All other burning must follow applicable state law. Garbage burning prohibited in subdivisions or on less than 5 acres.


While this limited restriction on residential burning has been lifted, most other burning remains prohibited year round. State law prohibits the burning on household garbage or man-made rubbish in County subdivisions or on lots less than 5 acres. Most cities and The Woodlands Township have local burning restrictions as well and it is the responsibility of homeowners to know the rules before they burn. Fines can range as high as $2000 depending on the jurisdiction.

Again under State Law, all commercial burning is prohibited and all commercial refuse must be properly disposed of. Land clearing debris may not be disposed of by burning on the surface of the ground. Montgomery County, as is most of the Houston area, is classified as “Non-Attainment” for air quality, requiring alternative methods for disposal of land clearing debris.

Options for Disposal of Land Clearing Debris
• Tree debris may be taken to a properly permitted recycling facility or landfill
• Mechanical chipping or mulching
• Air Curtain Incinerator permitted through TCEQ
