Waste Connections Secures $1 Million Settlement and Court Injunction Against Former Employee and Apex Waste Solutions in Noncompete Dispute

THE WOODLANDS, TX -- On May 30, 2024, Waste Connections US, Inc. and affiliates (together, “Waste Connections”) sued former employee Evan Sharp, and Sharp’s new employer Apex Waste Solutions, LLC and certain of its affiliates (“Apex”), in Colorado state court, to enforce Waste Connections’ noncompete and other contractual rights with Sharp. Waste Connections maintained Sharp’s employment with Apex violated its legally enforceable agreement.

Less than four months later, the court has entered an agreed Final Judgment and Permanent Injunction enforcing the restrictive covenants Sharp agreed to with Waste Connections, ordering Sharp and Apex to comply with the terms of the permanent injunction, and including a detailed apology statement by Sharp. The parties also signed a Settlement and Release Agreement to resolve the lawsuit, which includes a $1 million payment from the defendants to Waste Connections.
